According to the latest court document filed in the American Medical Systems multidistrict litigation (MDL) in the U.S. District Court for the Southern District of West Virginia, U.S. District Judge Joseph R. Goodwin recently selected bellwether cases following the bellwether case presentation on June 25, 2013.
Judge Goodwin selected four transvaginal mesh cases to go to trial as bellwether cases in the American Medical Systems MDL. The cases are: Lisa Fontes, et al. v. American Medical Systems, Inc.; Joann Serrano v. American Medical Systems, Inc.; Debbie K. Jilovec v. American Medical Systems, Inc.; and Mary Weiler, et al. v. American Medical Systems, Inc.
Judge Goodwin did not select a transvaginal mesh lawsuit from these four as the first to go to trial. As detailed in the latest pretrial order number 71, Judge Goodwin noted that he will narrow his selection down to two cases from these four, and down again to one case. The first bellwether trial is scheduled for December 3, 2013.
The second bellwether trial in the American Medical Systems MDL is scheduled for May 6, 2014. Judge Goodwin stated that he will employ the same process of selecting the case from a pool of cases.
The pretrial order goes on to describe how Judge Goodwin will select a bellwether case for the third round of American Medical Systems bellwether trials to take place July 2014. This bellwether trial will be specifically about American Medical Systems transvaginal mesh used to treat pelvic organ prolapse (POP). Judge Goodwin ordered both parties to submit three POP cases, from which he will select two cases in November 2013.
