In mid-April a Superior Court Judge in Bergen County New Jersey dismissed seven cases from the Nuvaring MCL.
According to the summary judgment order, the seven cases were dismissed from the MCL on the grounds that the plaintiffs in each NuvaRing lawsuit did not provide sufficient evidence connecting their injuries to the use of the NuvaRing contraceptive device.
Though bellwether trials in the New Jersey NuvaRing MCL have been interrupted temporarily during this case dismissal process, there are approximately over 200 more cases pending in the Nuvaring MCL. In such a large pool of cases, finding a strong NuvaRing case demonstrating a firm connection between the NuvaRing and blood clots is very possible.
In addition to the New Jersey NuvaRing MCL, NuvaRing lawsuits have been consolidated into a multidistrict litigation (MDL) in the U.S. District Court fo the Eastern District of Missouri. There have been discussions of bellwether trials scheduled for October in the NuvaRing MDL.
Plaintiffs in the NuvaRing MCL in New Jersey and the NuvaRing MDL in Missouri filed their lawsuits against Merck citing the pharmaceutical company’s failure to adequately warn about the blood clot risks associated with use of their contraceptive device.
