Filed on May 28, the pretrial order in <a href="../blog/ethicon-vaginal-mesh-mdl-update-defense-fact-sheets-due-in-early-april-for-ethicon-discovery-pool-cases/">Ethicon MDL 2327</a> reports on the defendants' request for the removal of certain Coloplast entities from plaintiffs' cases in all <a href="http://www.careydanis.com/medical-device/transvaginal-mesh/" target="_blank">transvaginal mesh lawsuits</a> consolidated into the five MDLs presided over by Judge Goodwin.

Though the pretrial order will have more of an affect on the <a href="http://www.wvsd.uscourts.gov/MDL/2387/index.html">Coloplast MDL 2387</a> itself, due to the closely related injuries detailed by plaintiffs, pretrial orders filed in one transvaginal mesh MDL in the West Virginia court are often filed in all of the MDLs.

The most recent pretrial order does not mean that the Coloplast MDL is being disbanded. Rather, it simply means that any mention of Coloplast subsidiaries, such as Coloplast A/S, Coloplast Manufacturing US, LLC, and Porges S.A., will be removed from plaintiffs' cases.

Like Ethicon's Gynecare Prolift <b>vaginal mesh</b>, Coloplast's bladder sling has been linked to erosion, contraction, severe pelvic pain, infection, and other debilitating health complications.

Following almost 3,000 adverse event reports citing problems with vaginal mesh implants, the U.S. Food and Drug Administration (FDA) released a <a href="http://www.fda.gov/MedicalDevices/Safety/AlertsandNotices/ucm262435.htm" target="_blank">safety communication</a> in July 2011 noting their continuing review of vaginal mesh products and studies.

According to the FDA's review, the most frequently reported health complication related to vaginal mesh involves <a href="http://www.careydanis.com/blog/carey-danis-lowe-pelvic-mesh-lawyers-weigh-in-on-ethicon-mdl-2327-and-gynecare-prolift-mesh-lawsuit-removal-request/">vaginal mesh erosion</a>. The FDA communicated that to resolve <b>vaginal mesh erosion</b>, women underwent numerous surgeries, and even then, the vaginal mesh implant could not be entirely removed, leaving women in extreme pain and discomfort.

Though bellwether trials in the New Jersey NuvaRing MCL have been interrupted temporarily during this case dismissal process, there are approximately over 200 more cases pending in the Nuvaring MCL. In such a large pool of cases, finding a strong NuvaRing case demonstrating a firm connection between the <b>NuvaRing and blood clots</b> is very possible.

In addition to the New Jersey NuvaRing MCL, NuvaRing lawsuits have been consolidated into a multidistrict litigation (MDL) in the U.S. District Court fo the Eastern District of Missouri. There have been discussions of bellwether trials scheduled for October in the <b>NuvaRing MDL</b>.

Plaintiffs in the NuvaRing MCL in New Jersey and the NuvaRing MDL in Missouri filed their lawsuits against Merck citing the pharmaceutical company's failure to adequately warn about the blood clot risks associated with use of their contraceptive device.

Judge Freeman made his ruling to void the $6.5 million compensatory award in Cooper v. Takeda following an argument from Takeda claiming lack of evidence connecting <a href="http://www.careydanis.com/blog/urologist-testifies-in-cooper-v-takeda-actos-lawsuit-about-bladder-cancer-in-california-superior-court/">Actos and bladder cancer</a> in the plaintiff.

The plaintiff and his lawyers are seeking an appeal of Judge Freeman's ruling.

In an article from the <a href="http://www.nytimes.com/2013/04/17/business/johnson-johnson-wins-case-on-artificial-hip.html?_r=0" target="_blank">New York Times</a>, the jury released a verdict stating that neither Johnson &amp; Johnson nor DePuy engaged in a misleading marketing campaign to promote the metal-on-metal hip implant.

In contrast to the Chicago DePuy Hip trial, in the first <a href="http://www.careydanis.com/blog/carey-danis-lowe-optimistic-about-depuy-asr-hip-lawsuits-following-johnson-johnson-loss/" target="_blank">DePuy ASR Hip lawsuit</a> to go to trial in California, the plaintiff Loren Kransky was awarded a compensatory award of $8.3 million.

				<content:encoded><![CDATA[Takeda Pharmaceuticals, the Japanese pharmaceutical giant responsible for the development and marketing of the diabetes drug Actos, concealed the association between <a href="http://www.careydanis.com/blog/diabetes-drug-actos-connected-to-bladder-cancer/" target="_blank">Actos and bladder cancer</a>, a jury was recently told in an <a href="../blog/urologist-testifies-in-cooper-v-takeda-actos-lawsuit-about-bladder-cancer-in-california-superior-court/" target="_blank">Actos trial</a>.

ccording to a <a href="http://www.businessweek.com/news/2013-04-15/takedas-actos-diabetes-drug-tied-to-cancer-jury-is-told">Bloomberg Businessweek</a> report on the Actos trial being heard in Los Angeles, as early as 2004, Takeda knew about the associated between Actos and bladder cancer. Furthermore, with this awareness, the Japanese pharmaceutical company failed to inform the U.S. Food and Drug Administration (FDA), according to the plaintiffs lawyer in the case, Michael Miller.

Closing arguments in the <a href="http://www.careydanis.com/practice-areas/pharmaceutical-litigation/actos-bladder-cancer-litigation/" target="_blank">Actos lawsuit</a> were delivered from Miller on April 15, with the jury moving into deliberation on or after April 16 following closing statements from Takeda's lawyers.

Due to Cooper's ailing state, Takeda's lawyers have pointed again and again to Cooper's health being to blame for his bladder cancer, not Actos. It will be interesting to see if this argument holds any weight during jury deliberation.

The case is <b>Cooper v. Takeda</b>, and is being heard in a California Superior Court in Los Angeles by Judge Kenneth Freeman. As the plaintiff, Jack Cooper, is in poor health, his Actos lawsuit was given priority in going to trial. Once Cooper's case is settled, Takeda still faces approximately 3,000 more Actos lawsuits, according to a Bloomberg Businessweek report.

The FDA approved Actos in 1999, and since then has ordered Takeda to continually update the drug's label in order to provide adequate warnings about various health risks associated with Actos use. The current <a href="http://www.accessdata.fda.gov/drugsatfda_docs/label/2011/021073s043s044lbl.pdf" target="_blank">Actos drug label</a> lists a warning about bladder cancer noting that in patients who have used Actos for longer periods, the risk of bladder cancer has increased considerably.

The Bayer Yaz patent decision was decided in the U.S. Court of Appeals for the Federal Circuit in Washington. The case is Bayer Healthcare Pharma v. Sandoz Inc. Bayer is currently seeking an appeal.

Though the drop in Yaz sales may be related to increasing competition from generic versions of drospirenone, Yaz has also been put in the negative spotlight for the contraceptive drug's association with health risks, specifically blood clots, stroke, deep vein thrombosis, and in some cases, these severe <b>Yaz side effects</b> have proven to be fatal. According to a <a href="http://www.bloomberg.com/news/2013-04-17/bayer-appeal-eu-patents-abbvie-intellectual-property.html" target="_blank">Bloomberg</a> article, Bayer spent $1.57 billion in 2012 towards legal costs in Yaz and Yasmin lawsuits.
