Mass Tort/Product Liability
When an individual suffers personal injury as a result of the neglect of a large corporation, the individual is usually represented on a "individual" basis by one attorney. During the 1970s, the courts extended the use of class actions to include personal injury cases caused by product failure or toxicity. More recently, however, many lawyers, commentators, and most importantly, the courts, have expressed concern about the use of the class action device in mass disaster and mass injury cases.
Consequently, Carey & Danis has begun organizing hundreds of individual claims in lieu of class actions. Depending on the circumstances, a mass tort is often a better remedy to deal with personal injury claims even though all of the claims may be caused by the same act of one corporation.
