A San Francisco Superior Court dismissed the case against Merck and Company on Sept. 10, 2015. The case centered on the NuvaRing medical device, a type of hormonal birth control.

Erika Langhart had 2 heart attacks in 2011 and died on Thanksgiving day. Her parents maintain that Erika died from complications caused by NuvaRing’s desogestrel, a progestin used in the drug.

A New York law firm promised the Langharts a jury trial to broadcast their grievances against the company. Now however, there’s no chance to openly hold Merck accountable because the court dismissed the case.

In 2014, Merck made an inconceivable $723 million from NuvaRing. Merck claims that NuvaRing has an “acceptable risk factor”. For the Langharts, nothing is “acceptable” about Erika’s death, other deaths or life altering injuries caused by NuvaRing.

Family Creates Nonprofit to Publicize Hazards of NuvaRing

nuvaringThe Langhart parents were expecting their daughter, Erika, to fly home for Thanksgiving. Instead, they got a call summoning them to a Virginia hospital, because their daughter had suffered multiple heart attacks. By the time they got to the Virginal Hospital Center, she was in a coma.

The doctor asked whether Erika was using birth control. Upon learning that Erika used NuvaRing, the doctor stated that “there’s a link between NuvaRing and pulmonary embolisms.” The doctors removed the contraceptive device immediately, but it was too late. A blood clot that started in her thigh caused extensive pulmonary embolisms, many episodes of cardiac arrest and eventual brain death.

The Langharts didn’t know that NuvaRing had been linked to other women’s deaths. NuvaRing’s manufacturer Merck admits that there’s a very small risk of blood clots, but maintains that there’s evidence to support the safety and efficacy of the NuvaRing.

Despite this claim, Merck settled a multidistrict litigation (MDL) for $100 million, because Organon, the original maker of the NuvaRing , “failed to adequately warn consumers about a heightened risk of blood clots associated with the use of NuvaRing, even though the manufacturer was aware that NuvaRing posed greater risks than other hormonal contraceptives.”

The Langharts, however, didn’t settle. They want Merck held accountable for failure to properly warn women of the risk. To further their mission, they created a nonprofit honoring their daughter. Using her name, they called the organization “Informed Choice for Amerika”, working with the mission of advising women about the hazards related to NuvaRing and the relative risks of hormonal contraceptives.

Unfortunately, the use of NuvaRing is widespread: it’s one of the most popular birth control products on the market.

NuvaRing Settlement Update: Court Orders Complete Funding

nuvaringThe NuvaRing Master Settlement Agreement drawn up in February 2014 for the NuvaRing multidistrict litigation (MDL) being heard in Missouri has been accepted by both parties, and is moving forward with funding fulfillment. The manufacturer of the NuvaRing, Organon, offered a $100 million settlement, and according to a recent court order, the deadline for complete funding is August 13, 2014.

As stated in the NuvaRing Master Settlement Agreement, claims that have not yet been filed may qualify for participation in the settlement if the case involves an injury associated with the use of the NuvaRing, and if the injury occurred before February 7, 2014.

St. Louis Family Filed NuvaRing Lawsuit After Daughter’s Death

NuvaRing User Suffered Life-Altering Blood Clots

nuvaringThe Huffington Post recently published an article in which the author describes her experience using the NuvaRing contraceptive device. Writing for the Huffington Post, Nancy Polanco describes using the NuvaRing for less than two months before landing in the emergency room.

Polanco’s NuvaRing nightmare began when she was having difficulty exercising. Later, she struggled to breathe to such as degree that she had to go to the emergency room, where doctors discovered that she had dangerously low oxygen levels. The reason for her breathing troubles and low oxygen levels were the result of her use of the NuvaRing.

Polanco had developed blood clots in her lungs, a condition known as a pulmonary embolism.

Now, Polanco, along with many other women who have used this contraceptive device, believes that NuvaRing’s manufacturer, Merck, failed to make users aware of the contraceptive device’s life-threatening and life-altering side effects.

In addition to the formation of blood clots, patients who use the NuvaRing have an increased risk of heart attack and stroke.

nuvaringAccording to a recent Madison-St. Clair Record article, NuvaRing lawsuits have recently been filed in the U.S. District Court for the Southern District of Illinois charging five defendants, among them Organon USA, with failure to properly warn healthcare providers and patients about risks of NuvaRing use.

Health complications commonly cited with the use of the NuvaRing contraceptive device include blood clots, deep vein thrombosis (DVT), stroke, heart attack, pulmonary embolism, blood clots, and in some cases, death. According to a Danish study published in May 2012 in the British Medical Journal, researchers discovered that women using a vaginal ring contraceptive device, such as the NuvaRing, experienced a significantly increased risk of developing blood clots.

In addition to the NuvaRing lawsuits in the U.S. District Court in Illinois, there is also a NuvaRing multidistrict litigation (MDL), known as In re: NuvaRing Products Liability Litigation MDL No. 1964, which is being heard in the U.S. District Court of the Eastern District of Missouri. The NuvaRing MDL is being presided over by U.S. District Judge Rodney W. Sippel.
