Update on New Jersey Mirena IUD Lawsuits

mirenalawsuitIn mid-December 2014, a new case management order (CMO) was filed in the New Jersey Mirena IUD multicounty litigation (MCL). The CMO detailed the defendant’s request to file motions for summary judgment on statute of limitations. Judge Brian R. Martinotti denied the request without prejudice.

The defendant filed their request as they most likely believe that the statute of limitations will preclude plaintiffs from winning a Mirena IUD lawsuit.

The case management order also laid out dates for future status conferences. The next status conference will take place on January 20, 2015.

As of December 15, 2014, there are 1,375 Mirena IUD lawsuits pending in the New Jersey Superior Court in Bergen County.

Yaz Lawsuit News: Discovery Deadline Extended in New Jersey Yaz MCL

yaz_lawsuit_settlements_mcl_mdl_multidistrict_litigation_yasmin_ocella_lawsuitsIn the Yaz, Yasmin, and Ocella multicounty litigation (MCL) in the Superior Court of New Jersey in Bergen County, the court filed a new case management order in mid-October. The court document concerns an extension of the discovery deadline, in addition to the next case management conference, which will be on November 21, 2013. The Yaz MCL is being heard by Judge Brian R. Martinotti.

MCLs like multidistrict litigations (MDLs) are created for efficiency. However, delaying the discovery process in order to build a stronger case, via the gathering of more evidence, means that both parties will be better prepared when it comes time for the bellwether trial process. This is a smart move on the part of the court, as having a dearth of evidence in the first bellwether trials could delay the legal process further.

Even so, the case management order does not reveal the reason for extending the deadline beyond the original date of December 31, 2013 to June 30, 2014.

As of late October, there are 390 cases pending in the Yaz MCL in New Jersey.

Mirena IUD Lawsuit News: Mirena IUD Lawsuits Consolidated into Multicounty Litigation in New Jersey

Judge Brian R. Martinotti will oversee the Mirena IUD proceedings. The case is In Re: Mirena Litigation Case No. 297.

Both parties are scheduled to meet for an initial conference on June 17, 2013. On the agenda for the conference is a discussion of how to coordinate with the Mirena IUD multidistrict litigation (MDL) No. 2434 in the U.S. District Court for the Southern District of New York.

According to a Reuters report on the Mirena IUD MCL in New Jersey, there are approximately 113 cases that have been filed in the Bergen County court as of May 20, 2013.

Plaintiffs in the Mirena MCL and the Mirena MDL have filed their Mirena IUD lawsuits alleging that Bayer neglected to sufficiently warn users that the plastic contraceptive device could cause serious injury through uterus perforation and device migration.
