2700 Testosterone Gel Lawsuits in US

testoserone_gelOver 2,700 testosterone gel lawsuits are pending in the US. According to a Forbes article from late October 2015, testosterone lawsuits numbered around 2,000 in August 2015. In the ensuing months, even more men who suffered serious testosterone side effects stepped forward, bringing the total near 3,000.

A legal representative commented in the Forbes article that the lawsuits are “not quite to the halfway point in terms of the number of suits we’re going to see.”

Lawsuits consolidated in Chicago

Testosterone lawsuits are consolidated in a multidistrict litigation (MDL) in Chicago. The MDL cites 7 companies that make testosterone products.

The US District Court Judge managing the MDL, Judge Matthew Kennelly, is moving pretrial proceedings along at an efficient pace. In late 2016, the court will begin the bellwether trial process; at this time, rulings will be made on bellwether testosterone lawsuits that both parties carefully selected as representative of a majority of the MDL lawsuits.

AbbVie and AndroGel

This first round of bellwether cases scheduled for 2016 involves AbbVie and their testosterone product, AndroGel.

These AndroGel lawsuits allege that AbbVie’s testosterone product caused blood clots, heart attacks, and strokes. These lawsuits also argue that AbbVie’s AndroGel marketing campaigns misled them to believe the product as safe.

Decline in AndroGel sales

According to the Forbes article cited above, AndroGel sales plummeted as testosterone lawsuits rose. AndroGel sales dropped by 32% in the first 6 months of 2015.

Family Creates Nonprofit to Publicize Hazards of NuvaRing

nuvaringThe Langhart parents were expecting their daughter, Erika, to fly home for Thanksgiving. Instead, they got a call summoning them to a Virginia hospital, because their daughter had suffered multiple heart attacks. By the time they got to the Virginal Hospital Center, she was in a coma.

The doctor asked whether Erika was using birth control. Upon learning that Erika used NuvaRing, the doctor stated that “there’s a link between NuvaRing and pulmonary embolisms.” The doctors removed the contraceptive device immediately, but it was too late. A blood clot that started in her thigh caused extensive pulmonary embolisms, many episodes of cardiac arrest and eventual brain death.

The Langharts didn’t know that NuvaRing had been linked to other women’s deaths. NuvaRing’s manufacturer Merck admits that there’s a very small risk of blood clots, but maintains that there’s evidence to support the safety and efficacy of the NuvaRing.

Despite this claim, Merck settled a multidistrict litigation (MDL) for $100 million, because Organon, the original maker of the NuvaRing , “failed to adequately warn consumers about a heightened risk of blood clots associated with the use of NuvaRing, even though the manufacturer was aware that NuvaRing posed greater risks than other hormonal contraceptives.”

The Langharts, however, didn’t settle. They want Merck held accountable for failure to properly warn women of the risk. To further their mission, they created a nonprofit honoring their daughter. Using her name, they called the organization “Informed Choice for Amerika”, working with the mission of advising women about the hazards related to NuvaRing and the relative risks of hormonal contraceptives.

Unfortunately, the use of NuvaRing is widespread: it’s one of the most popular birth control products on the market.

Testosterone Gel Makers Served Personal Injury Lawsuits

There have also been reports of testosterone gel fatalities.

A number of studies, including one published in November 2013 by the Journal of the American Medical Association, demonstrate a link between testosterone gels and poor cardiovascular health.

According to a doctor interviewed for an article recently published by the Indystar, an Indianapolis, Indiana newspaper, testosterone replacement drugs, like Androgel and Axiron, can trigger the thickening of a patient’s blood, and thus, create a situation where blood clots are more likely to develop. As a result of this knowledge about how testosterone replacement drugs affect blood consistency, this particular doctor closely monitors his patients.

Another doctor interviewed by the Indy Star about testosterone replacement therapy expressed uncertainty about the safety of drugs like testosterone gels. This doctor stated that he does not write testosterone prescriptions for patients seeking testosterone gels to treat low testosterone, or low T.

It is heartening to hear that these two particular healthcare providers are extremely careful in their dealings with testosterone gels, especially in light of the dangers that these gels has been known to cause.

Ontario Yaz & Yasmin Class Action Lawsuit Approved

The unique aspect of this class action lawsuit is that it automatically includes Yaz and Yasmin users, regardless of whether or not they have formally requested inclusion in the case. The legal representatives of the plaintiffs have posted information about how to opt-out of the case. If a woman prefers to opt-out, she must do so before February 9, 2015.

This Yaz and Yasmin class action lawsuit targets the drugs’ manufacturer, Bayer, and centers around injuries suffered by plaintiffs. These Yaz and Yasmin injuries include blood clots, pulmonary embolism, deep vein thrombosis, gallbladder disease, and stroke. The Canadian case alleges that Bayer was aware of the risks associated with both of their contraceptive drugs, but failed to give proper warning to health care providers and patients regarding these serious side effects.

Yaz & Yasmin Lawsuit Update: Israeli Women & Yasmin Lawsuits

bayerIsraeli women who have suffered injuries, such as blood clots and pulmonary embolism, from the use of the birth control pill Yasmin are standing up against Bayer. These women have applied to file a Yasmin class action lawsuit against the drug’s manufacturer, Bayer.

According to Israeli newspaper, Haaretz, the class action lawsuit calls for compensation in the amount of NIS 204 million, which is over $53 million USD. The women involved in the Yasmin lawsuit claim that Bayer was negligent in warning patients and healthcare providers about the risks associated with use of the birth control pill.

In fact, the Haaretz article goes on to explain that the proposed suit alleges that Bayer was aware of the blood clot risk, but failed to provide sufficient update.

Bayer did eventually distribute safety information for Yasmin that included details on the blood clot risk. However, as the updated information only appeared in a safety pamphlet, this distribution method was insufficient in spreading the word on such a deadly Yasmin side effect, according to the women involved in the lawsuit.

One of the women involved in the case, Ruth Teitler, used Yasmin, and then suffered a pulmonary embolism. She told Haaretz that, after a year of using Yasmin, she experienced chest pain and trouble breathing to such a degree that she went to the hospital.

Once there, x-rays revealed that her lungs were overrun with blood clots.

NuvaRing & The Plight of One Family

However, a mere five days later, the family was saddened by the news that one of their own had succumbed to a blood clot. The family member, Angela Miller, was only 28 years old.

According to a news story from WTVC News Channel 9 in the Tennessee Valley, Miller had been using a contraceptive device called the NuvaRing. In their report, WTVC cites data from the U.S. Food & Drug Administration on NuvaRing fatality and injury numbers. Those records show 224 deaths and 3,000 serious injuries.

Manufactured by Merck, the NuvaRing was introduced in 2002, and has been associated with blood clots, heart attack, stroke, pulmonary embolism, and deep vein thrombosis (DVT).

Following their loss, the Miller family began a campaign to raise awareness about NuvaRing side effects with the hopes that what befell their family would not happen to any other families.

Yasmin Stroke Sufferer Awarded $14 Million

yaz_lawsuit_yasmin_side_effects_lawsuits_dvt_blood_clot_settlementsA Chicago jury awarded a 37 year old woman $14 million after hearing that she suffered a life-altering stroke while using the contraceptive drug Yasmin for less than two weeks. According to a local ABC News report on the trial, the woman, Mariola Zapalski, has been virtually immobile since suffering from her stroke in 2007. With the left side of her body paralyzed as a result of her stroke, Zapalski now uses a wheelchair.

The plaintiff began using Yasmin in 2007. After a mere thirteen days on the drug, Zapalski suffered a stroke.

Yasmin and Yaz, both contraceptive drugs manufactured by Bayer, have been linked to blood clots and stroke, as well as heart attacks, pulmonary embolism, and deep vein thrombosis (DVT). As the U.S. Food & Drug Administration (FDA) has received a large amount of adverse event reports linking the two drugs to severe side effects, the organization mandated an update to Yasmin’s label last year with the purpose of better informing users of the drug having been known to cause a serious risk of Yaz blood clot formation.

Research Participant Injured by Mirena IUD

mirena_mdl_lawsuit_dvt_blood_clot_settlementsA woman who participated in a Washington University School of Medicine study claims to have sustained permanent injuries from the intrauterine contraceptive device (IUD), Mirena. The research study supplied participants with free contraception over a three year period.

The woman, Deanna Delancy, said in an article recently published by the St. Louis Post-Dispatch, that in making her contraception selection, researchers offered her little information on the risks of the Mirena IUD. Delancy said that if she had known about the risks associated with the device, she would not have chosen it.

According to the St. Louis Post-Dispatch article, researchers in the study were implementing the Mirena IUD in a way discouraged by Bayer, the manufacturer behind the contraceptive device. In their defense, the School of Medicine stated that issuing medical products to patients in an off-label manner is not a rare decision made by medical experts.

As a result of what she claims to be injuries sustained from the Mirena IUD, Delancy has undergone two surgical operations to repair heart valves. Furthermore, due to her increased risk of developing blood clots, she now consumes a blood-thinning medication.

Though the Mirena IUD has been more closely associated with tissue perforation, it is not uncommon for certain types of hormones used in contraceptive devices to heighten the risk of developing a blood clot. The synthetic hormone used in the Mirena IUD is levonorgestrel, a second generation progestin.
