Australian Women File Yaz Lawsuits

nuvaringThe Langhart parents were expecting their daughter, Erika, to fly home for Thanksgiving. Instead, they got a call summoning them to a Virginia hospital, because their daughter had suffered multiple heart attacks. By the time they got to the Virginal Hospital Center, she was in a coma.

The doctor asked whether Erika was using birth control. Upon learning that Erika used NuvaRing, the doctor stated that “there’s a link between NuvaRing and pulmonary embolisms.” The doctors removed the contraceptive device immediately, but it was too late. A blood clot that started in her thigh caused extensive pulmonary embolisms, many episodes of cardiac arrest and eventual brain death.

The Langharts didn’t know that NuvaRing had been linked to other women’s deaths. NuvaRing’s manufacturer Merck admits that there’s a very small risk of blood clots, but maintains that there’s evidence to support the safety and efficacy of the NuvaRing.

Despite this claim, Merck settled a multidistrict litigation (MDL) for $100 million, because Organon, the original maker of the NuvaRing , “failed to adequately warn consumers about a heightened risk of blood clots associated with the use of NuvaRing, even though the manufacturer was aware that NuvaRing posed greater risks than other hormonal contraceptives.”

The Langharts, however, didn’t settle. They want Merck held accountable for failure to properly warn women of the risk. To further their mission, they created a nonprofit honoring their daughter. Using her name, they called the organization “Informed Choice for Amerika”, working with the mission of advising women about the hazards related to NuvaRing and the relative risks of hormonal contraceptives.

Unfortunately, the use of NuvaRing is widespread: it’s one of the most popular birth control products on the market.

Woman Suffers Mirena IUD Complication

Update on New Jersey Mirena IUD Lawsuits

mirenalawsuitIn mid-December 2014, a new case management order (CMO) was filed in the New Jersey Mirena IUD multicounty litigation (MCL). The CMO detailed the defendant’s request to file motions for summary judgment on statute of limitations. Judge Brian R. Martinotti denied the request without prejudice.

The defendant filed their request as they most likely believe that the statute of limitations will preclude plaintiffs from winning a Mirena IUD lawsuit.

The case management order also laid out dates for future status conferences. The next status conference will take place on January 20, 2015.

As of December 15, 2014, there are 1,375 Mirena IUD lawsuits pending in the New Jersey Superior Court in Bergen County.

Ontario Yaz & Yasmin Class Action Lawsuit Approved

yaz_lawsuit_bayer_multidistrict_litigation_yaz_settlements_yaz_yasmin_lawsuit_settlementsThe Ontario Superior Court of Justice has approved a Yaz and Yasmin class action lawsuit. The lawsuit includes all women residing in Ontario and Quebec who used Yaz and/or Yasmin from 2004 – 2011.

The unique aspect of this class action lawsuit is that it automatically includes Yaz and Yasmin users, regardless of whether or not they have formally requested inclusion in the case. The legal representatives of the plaintiffs have posted information about how to opt-out of the case. If a woman prefers to opt-out, she must do so before February 9, 2015.

This Yaz and Yasmin class action lawsuit targets the drugs’ manufacturer, Bayer, and centers around injuries suffered by plaintiffs. These Yaz and Yasmin injuries include blood clots, pulmonary embolism, deep vein thrombosis, gallbladder disease, and stroke. The Canadian case alleges that Bayer was aware of the risks associated with both of their contraceptive drugs, but failed to give proper warning to health care providers and patients regarding these serious side effects.

Mirena Lawsuit Numbers Continue to Rise

mirenaThe Judicial Panel on Multidistrict Litigation (JPML) released a document on October 15, 2014 that supplied an up-to-date pending lawsuit count for the Mirena multidistrict litigation (MDL) being heard in a federal court in New York. According to this document, there are currently 1,042 Mirena lawsuits pending before U.S. District Judge Cathy Seibel.

This update from the JPML makes it clear that the Mirena intrauterine device (IUD) continues to cause serious injuries to women.

Some known Mirena side effects include perforation, device migration, and infection.

Such injuries could have been prevented if product transparency and honesty were of any importance to the manufacturer of the Mirena. However, in this situation, Bayer misrepresented this contraceptive device in marketing campaigns by making claims about it being a safe and effective choice for women. As the Mirena lawsuits in New York indicate, these claims are false and deceptive.

Mirena IUD Users Suffer Serious Injuries, Says ABC News in Detroit

mirena_iud_lawsuit_settlements_class_action_lawsuit_mirena_mdlThe ABC News station in Detroit, WXYZ Detroit, aired a report in late August 2014 on Mirena intrauterine device (IUD) cases in the U.S. The news story chronicled one woman’s tragic experience with Bayer’s flawed contraceptive device.

After seeing her doctor to receive the Mirena IUD, the woman, named Sara, had to have the device removed surgically, as it has perforated her uterus, a phenomenon often referred to as Mirena IUD uterine perforation, or uterine rupture.

The WXYZ Detroit report also revealed the vast number of complaints filed with the U.S. Food and Drug Administration (FDA) about the Mirena IUD, and the sometimes serious injuries that motivated filing the FDA complaint in the first place. According to the data gathered by the Detroit news channel, the FDA has received almost 5,000 adverse event reports about Mirena device dislocation, what is also termed as device migration, wherein the contraceptive device dislodges from the uterus, and travels to other parts of the body.

There have been many cases in which Mirena IUDs that have dislodged and have migrated elsewhere in the body have caused serious internal damage.

As detailed in the Detroit news report, one woman suffered liver lacerations from the Mirena IUD, and another woman, only in her early twenties, had to undergo a hysterectomy and an appendectomy as a result of Mirena IUD migration.

From such horrific accounts, it is clear that the Mirena IUD poses serious health risks to women.

Reports Show Decline in Yaz Sales

yaz_lawsuitIn a recent financial report, Bayer, the pharmaceutical company behind the controversial contraceptive drug Yaz, published information showing that Yaz sales have been on the decline. According to Bayer’s report released in late July 2014, sales of Yaz have seen a significant drop when comparing the second quarter of 2013 to that of 2014.

Yaz sales brought in $250 million for Bayer in the second quarter of 2013, but only $191 million in the same quarter of 2014.

This sales decline may be related to the thousands of Yaz lawsuits that have been filed across the United States.

Also in their quarter two report is information on their $1.8 billion Yaz settlement.

NuvaRing & The Plight of One Family

nuvaring_lawsuit_heart_attackA Tennessee Valley family gathered together for the 2013 holiday season, and everyone was in good spirits. However, a mere five days later, the family was saddened by the news that one of their own had succumbed to a blood clot. The family member, Angela Miller, was only 28 years old.

According to a news story from WTVC News Channel 9 in the Tennessee Valley, Miller had been using a contraceptive device called the NuvaRing. In their report, WTVC cites data from the U.S. Food & Drug Administration on NuvaRing fatality and injury numbers. Those records show 224 deaths and 3,000 serious injuries.

Manufactured by Merck, the NuvaRing was introduced in 2002, and has been associated with blood clots, heart attack, stroke, pulmonary embolism, and deep vein thrombosis (DVT).

Following their loss, the Miller family began a campaign to raise awareness about NuvaRing side effects with the hopes that what befell their family would not happen to any other families.

Mirena IUD Lawsuits in Canada

mirena_mdl_lawsuit_dvt_blood_clot_settlementsAfter choosing the Mirena intrauterine device (IUD) for birth control, a Canadian woman experienced cramping so painful that she struggled to walk. This woman, recently interviewed for Canada’s CTV News, decided to return to her doctor to get the contraceptive device removed. Initially, her doctor could not locate the the device, as it had perforated her uterus, and migrated to her hip bone area.

The Mirena IUD, which is manufactured by Bayer, has been known to perforate the uterus, and to migrate to other parts of the body, most often the abdominal region. The woman interviewed by CTV News faults Mirena’s manufacturer with failure to warn about the risk of device migration.

The Canadian Mirena label differs from the U.S. label in that it excludes the any mention of device migration. Thus, women who choose to use this form of birth control are not fully informed about the device.

As a result of this labeling omission, Canadian women are in the process of filing lawsuits against Bayer.

In the U.S., women who claim to have been injured by the Mirena IUD have also filed lawsuits targeted at Bayer. These women have experienced device perforation, migration, ectopic pregnancy, pelvic inflammatory disease, and infertility.
